Ground Rules For Guests
*
Please read carefully and select 'Agree' below to acknowledge agreement. We require everyone to stick to these simple rules for being a great guest:
Treat our home like your own. Follow the house rules. Communicate promptly with the Host if issues come up
Details of the ground rules:
Cleanliness: Guests should not leave the listing in a state that requires excessive or deep cleaning (ex: with moldy dishes, soiled carpets, stains from pets, etc.). Cleaning fees are only meant to cover the cost of standard cleaning between reservations (ex: laundry, vacuuming, etc.).
Litter: Guests should put their trash in designated trash receptacles and be mindful of excessive amounts of trash.
Damage: Where guests cause damage that is beyond normal wear and tear, we expect guests to inform Hosts of the damage as soon as possible and work with the Host to find a reasonable solution. Guests are expected to pay reasonable requests for reimbursement if they’re responsible for damage, missing items, or unexpected cleaning costs.
Approved guests: Guests should respect the approved number of guests and should ask their Host if they're unsure about the rules for visitors. Disruptive gatherings are always prohibited.
Check-in time: Guests should respect their Host’s check-in window. Any check-in before or after the designated window should be approved by the Host.
Checkout time: Guests should complete checkout by the designated checkout time indicated on the reservation confirmation email, and should not leave belongings at the listing past the designated checkout time for storage or later pickup without prior approval from the Host.
Smoking: Guests should not smoke inside the cabin under any circumstances. This includes the use of tobacco, cannabis, e-cigarettes, etc.
Approvals for pets: Guests should not bring any pets inside the cabin without prior approval or bring more pets than are approved. Guests must inform the Host about any pets brought inside the cabin.
Noise: Guests should respect designated quiet hours and should not disturb the surrounding community with a disruptive level of noise (ex: loud music, shouting, slamming doors, etc.). We have wonderful neighbors and it's imperative we respect them.
Commercial film and photography: Guests should not participate in film or photography at the cabin that is intended for commercial use or profit without documented permission from the Host.
Communicate promptly with the Host if issues come up. Good communication between a Host and guest is important for successful stays. When guests are able to (ex: not out of cell phone range, etc.), they should respond to Hosts within 24 hours when a Host is reaching out to resolve an issue.

Guest Release & Waiver

THIS AGREEMENT (the “Agreement”) entered into by and between the undersigned as a guest(s) of Onward Industries Inc (at times, depending on context, referred to herein as “You”, “Your”, and/or “Guest”) and both Onward Industries Inc and the owners of 608 Sugarloaf Blvd Big Bear, CA 92314 ("Owner"), relating to the temporary use of the retreat/vacation rental of the property located at 608 Sugarloaf Blvd Big Bear, CA 92314 (the “Premises”).
USE OF PREMISES. Your use of the Premises is limited to that of a short-term vacation/retreat rental and you have no other rights to the Premises other than as a short-term licensee. Your use of the Premises shall commence at 3:00 p.m. on the day of check-in and promptly terminate at 10:00 a.m. on the day of check-out (the “Stay”) unless otherwise agreed upon.
GUEST LIMITS. The maximum amount of person(s) authorized by You to be at the Premises shall be the number stated on your reservation confirmation, except for delivery persons (e.g., food providers, uber or taxi drivers) who promptly leave after such delivery or pick-up. These limitations apply regardless of whether such persons are staying the night or just visiting (“Visitors”). All guests (“Guests”) must be 18 years of age unless specifically agreed to in writing by Onward Industries Inc. If a minor(s) is among the Guests, You acknowledge and agree that You are solely responsible for the supervision of the minor(s) throughout the duration of the stay, and You represent and warrant that you have read the GUEST RELEASE AND WAIVER provisions below and agree to such provisions on the minor’s behalf. You further represent and warrant that all other Guests or Visitors at the Premises have read and agreed to the application to such person(s) of the terms of this Agreement including, without limitation, the GUEST RELEASE AND WAIVER and the GROUND RULES FOR GUESTS.
DAMAGES TO PREMISES. You agree to pay for all damages to the Premises caused by any and all Guests and/or Visitors during the Stay. Onward Industries Inc may withhold all or part of your deposit if there is a failure to abide by the rules in this Agreement, the house manual, and/or any written or oral directions received from Onward Industries Inc or Owner. If the cost of damages, losses, or missing items resulting from Guests and/or Visitors failure to abide by the terms of this Agreement should exceed the amount of the deposit, Onward Industries Inc will charge the Guest for the difference and/or pursue legal action. Cause(s) for withholding deposit funds, charging Guest’s credit card and/or pursuing legal action include, but are not limited to: damage to Premises or contents; missing or broken items; lost keys; required extra cleaning; failure to comply fully with the departure checklist; smoke odors or damage; mailing charges for items left behind; unauthorized persons
visiting or staying at the Premises; the presence of a pet without authorization; noise complaints after 10pm, including related fines; trespassing on neighboring properties; and unauthorized late checkout.
GUEST RELEASE AND WAIVER. IN CONSIDERATION OF YOUR RESERVATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND PROMISE NOT TO SUE ONWARD INDUSTRIES INC AND/OR OWNER (WHICH SHALL INCLUDE FOR PURPOSES OF THIS AGREEMENT, WITHOUT LIMITATION, ITS EMPLOYEES, BOARD MEMBERS, AGENTS, SUCCESSORS, ASSIGNS, AND THE PROPERTY OWNER) FOR ANY CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES (WHETHER ECONOMIC OR NON-ECONOMIC), DAMAGES, EXPENSES, COSTS OR LIABILITIES OF ANY NATURE WHATSOEVER ARISING FROM OR IN CONJUNCTION WITH THE STAY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, EXCEPT THAT FOR INTENTIONAL OR RECKLESS MISCONDUCT BY ONWARD INDUSTRIES INC. YOU FURTHER EXPRESSLY WAIVE ANY AND ALL PROTECTIONS OF CALIFORNIA CIVIL CODE SECTION 1542 WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
ASSUMPTION OF THE RISKS. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, YOU KNOWINGLY, VOLUNTARILY AND FREELY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, OF PARTICIPATING IN EACH EXPERIENCE YOU MAY PLAN AT THE PREMISES (E.G., YOGA, HIKING), EVEN IF THOSE RISKS ARISE FROM THE NEGLIGENCE OR CARELESSNESS OF ONWARD INDUSTRIES INC OR OTHERS, OR DEFECTS IN THE EQUIPMENT, PREMISES, OR FACILITIES USED DURING THE STAY, OR OTHERWISE, AND YOU ASSUME FULL PERSONAL RESPONSIBILITY FOR PARTICIPATING IN ANY AND ALL SUCH EXPERIENCES.
APPLICABLE LAW. Any legal or equitable claim that may arise from participants in the above shall be resolved under California law with venue in San Bernardino County.
UNENFORCEABLE TERMS. If any portion of this Agreement is held to be illegal or otherwise unenforceable, the balance of the Agreement shall continue in full force and effect.
NO DURESS. You agree and acknowledge that you came under no pressure or duress to sign this Agreement and that You have been given a reasonable opportunity to review it, both personally and with legal counsel of your choosing, before signing.
NEUTRAL INTERPRETATION. In the event any uncertainty or ambiguity is found to exist in the interpretation of the Agreement, the Agreement shall be interpreted in a neutral manner and without reference to any party’s role in preparation of the Agreement.
